EXECUTIVE ORDER NO. 109

 

REORGANIZING THE NATIONAL COUNCIL ON DISABILITY AFFAIRS, FURTHER AMENDING EXECUTIVE ORDER NO 709 (S. 2008) FOR THE PURPOSE

 

WHEREAS, Presidential Decree (PD) No. 1509 (s. 1978), as amended by PD No. 1761 (s. 1981), created the National Commission Concerning Disabled Persons (NCCDP) to direct, coordinate, and integrate the planning, management, and implementation of all activities of government agencies, and monitor the implementation of national laws and international commitments relating to the welfare, protection, and promotion of rights and well-being of disabled persons;

WHEREAS, EO No. 709 (s. 2008), as amended by EO No. 33 (s. 2011), renamed the NCWDP as the 鶹ý (鶹ý) and redefined the functions and organizational structure of the Council;

WHEREAS, Section 8 of Republic Act (RA) No. 7722 or the “Higher Education Act of 1994” mandates the Commission on Higher Education (CHED) to promote relevant and quality higher education and ensure that it is accessible to all;

WHEREAS, Section 5 of RA No. 11201 or the “Department of Human Settlements and Urban Development (DHSUD) Act” provides that the DHSUD shall be the central housing authority of the Philippines tasked to improve Filipino communities by making housing and human settlements affordable, resilient, and inclusive;

WHEREAS, Section 4, Article II of RA No. 12145 provides Department of Economy, Planning, and Development (DEPDev) shall serve as the primary policy, planning, coordinating, and monitoring arm of the Executive Branch of the government on national economy.

WHEREAS, according to 鶹ý, the inclusion of CHED, DHSUD, and DEPDev as members of 鶹ý is crucial in ensuring that all persons with disability (PWDs) will have equal access to quality higher education, adequate and affordable housing, and inclusive socioeconomic development; and

WHEREAS, Section 17, Article VII of the Constitution vests in the President the power of control over all the Executive departments, bureaus, and offices, and the mandate to ensure the faithful execution of laws;

NOW, THEREFORE, I, FERDINAND R. MARCOS, JR., President of the Philippines, by virtue of the powers vested in me by the Constitution and existing laws, do hereby order:

Section 1. Amendment. Section 3 of EO No. 709, as amended, is hereby further amended to read as follows:

“Section 3. Composition of the Council. The National on Disability Affairs is composed of the Governing Board and its Secretariat. The Governing Board, hereinafter referred to as the “Board”, shall be headed by the Secretary of the Department of Social Welfare and Development as ex-officio Chairperson, with the following members:

Department of Health;

Department of Labor and Employment;

Department of Education;

Department of the Interior and Local Government;

Department of Trade and Industry;

Department of Public Works and Highways;

Department of Transportation;

Department of Information and Communications Technology;

Department of Foreign Affairs;

Department of Justice;

Department of Human Settlements and Urban Development;

Department of Economy, Planning, and Development;

Commission on Higher Education;

Philippine Information Agency;

Technical Education and Skills Development Authority; and Six (6) private individuals including two (2) representatives from civic groups and cause-oriented organizations with the welfare of PWDs, all of whom shall be appointed by the President upon the favorable recommendation of the Chairperson.

 

The heads of the concerned departments and agencies shall as much as possible attend the meetings of the Council. In their absence, department heads shall designate permanent and alternate representatives, preferably with the rank of Undersecretary and Assistant Secretary, respectively, who may attend and participate at meetings of the Board of them.”

 

Section 2. Unaffected Provisions. Except as expressly modified by this Order, all other provisions of EO No. 709, as amended, shall remain in full force and effect.

 

Section 3. Repeal. All orders, rules and regulations, and other issuances or arts thereof which are inconsistent with the provisions of this Order, are hereby repealed or modified accordingly.

WHEREAS, the Philippines is a State Party to the United Nations Convention on the Rights of Persons with Disabilities (UNCRPD);

WHEREAS, the UNCRPD mandates States Parties to promote actively an environment in which persons with disabilities can effectively and fully participate in the conduct of public affairs, without discrimination and on an equal basis with others;

WHEREAS, the 鶹ý (鶹ý), created by virtue of Executive Order No. 709, is the lead agency for the formulation of policies for persons with disabilities;

WHEREAS, E.O. 709 likewise provides that the 鶹ý shall conduct consultative meetings with all stakeholders;

WHEREAS, E.O. 709 also provides for the creation of various Sub-Committees for these purposes;

WHEREAS, the National Anti-Poverty Commission (NAPC) passed Resolution No. 10 Series of 2025 (A Resolution Requesting the 鶹ý (鶹ý) to Adopt the National Anti-Poverty Commission – Persons with Disability Sectoral Council (NAPC-PWDSC) as a Member of All Subcommittees of the 鶹ý);

WHEREAS, NAPC is recognized under the Social Reform and Poverty Alleviation Act (Republic Act No. 8425) as the coordinating and advisory body to institutionalize the government’s social reform agenda, with the NAPC-PWDSC being a participatory mechanism for the disability sector in poverty reduction and inclusive development;

WHEREAS, inclusion of the NAPC-PWDSC in all 鶹ý Sub-Committees will operationalize its mandate under RA 8425 and will help streamline 鶹ý and NAPC policies and programs relating to making the rights real for persons with disabilities;

WHEREAS, 鶹ý Board Resolution No.4 S.2024, “A Resolution Delegating Approval of Succeeding Council Resolutions and/or its Equivalent to the 鶹ý Chairperson and Designated Officials”, duly authorized the 鶹ý Chairperson and the 鶹ý Executive Director to sign this Resolution for and on behalf of the 鶹ý Governing Board.

 

NOW, THEREFORE, RESOLVED as it is hereby resolved, that NAPC-PWDSC is established as a member of all 鶹ý Subcommittees;

RESOLVED FURTHER, that NAPC-PWDSC shall, after the approval of this Resolution, submit a list of one (1) permanent and one (1) alternate representative to each of 鶹ý’s Sub-Committees;

RESOLVED FURTHER, that this membership shall be in force for a period of one (1) year from approval hereof;

RESOLVED FURTHER, that the Chairperson of each Sub-Committee, in coordination with the 鶹ý Secretariat, shall prepare an evaluation report with respect to the participation of the NAPC-PWDSC in their respective Sub-Committees, which reports shall then be collated for circulation to the Board;

RESOLVED, FINALLY, that the Board shall, in the next succeeding Board Meeting after the expiration of the aforementioned membership, deliberate and vote on the continuation of said NAPC-PWDSC membership to the various 鶹ý Sub-Committees.

A RESOLUTION AUTHORIZING THE 鶹ý EXECUTIVE DIRECTOR TO SOLICIT, RECEIVE, AND ADMINISTER IN-KIND DONATIONS ON BEHALF OF THE COUNCIL, SUBJECT TO REPORTING REQUIREMENTS AND A RULE OF PREFERENCE

WHEREAS, Executive Order No. 709, Series of 2008, redefined the functions and organizational structure of the National Council for the Welfare of Disabled Persons, renaming it as the 鶹ý (鶹ý), and attaching it to the Office of the President;

WHEREAS, Executive Order No. 33, Series of 2011, transferred the 鶹ý from the Office of the President to the Department of Social Welfare and Development (DSWD), designating the DSWD Secretary as the ex-officio Chairperson of the Council;

WHEREAS, Section 8 of Executive Order No. 709 provides that the Council, through the Chairperson or such other official as may be authorized by the Board, shall solicit and accept gifts, grants, and donations in accordance with government rules, regulations, and policies;

WHEREAS, Section 8 further states that such gifts, grants, and donations shall be administered or disbursed by the Council for the purpose for which they were given or, in the absence of such, as the Board may determine, in accordance with applicable laws, rules, and regulations;

WHEREAS, under Executive Order No. 292 (Administrative Code of 1987), particularly Book IV, Chapter 9, Section 31, the authorization of specific duties is recognized as a mechanism for ensuring efficiency and effectiveness in public administration;

WHEREAS, Republic Act No. 9184 (Government Procurement Reform Act) and its 2016 Implementing Rules and Regulations (IRR), as amended by Republic Act No. 12009, provide the guidelines for the receipt and administration of donations in all government agencies;

WHEREAS, the Department of Social Welfare and Development, through the Office of the Undersecretary for International Affairs and Attached and Supervised Agencies, concurred with the request to authorize the 鶹ý Executive Director to act as the official signatory in the receipt and administration of donations, provided that such authority is expressly granted by the 鶹ý Board through a resolution;

NOW, THEREFORE, BE IT RESOLVED, AS IT IS HEREBY RESOLVED, that the Board of the 鶹ý authorizes the Executive Director of the 鶹ý to solicit, receive, and administer in-kind donations, gifts, and grants on behalf of the Council in accordance with Section 8 of Executive Order No. 709 and subject to all applicable government rules, regulations, and auditing standards;

RESOLVED FURTHER, that the Executive Director shall:

  1. Ensure that all in-kind donations are properly documented, managed, administered, and disbursed strictly for the purposes for which they were given or, in the absence of such, as determined by the Board, in accordance with applicable laws, rules, and regulations, including COA rules and DBM guidelines;
  2. Submit a comprehensive report to the 鶹ý Board on a quarterly basis or as may be required, detailing all donations received and their corresponding use and disbursement;
  3. Strictly observe that only in-kind donations shall be accepted under this authority, while all cash donations shall be directly accepted by the DSWD Secretary as Chairperson of the Council, following relevant financial and auditing policies;
  4. Observe the following rule of preference in accepting and processing donations: a. Priority shall be given to donations that directly support programs and services for persons with disabilities; b. Donations from sources aligned with government ethics and transparency standards shall be preferred; c. Donations entailing minimum or no additional cost to the Council shall be prioritized; d. Donations with clear documentation and provenance shall be given preference; e. All donations must be in accordance with 鶹ý’s existing strategic goals and operational capacity.

RESOLVED FINALLY, that copies of this Resolution be furnished to the Department of Social Welfare and Development, the Commission on Audit, and other concerned agencies for their information and appropriate action.

RESOLUTION ENFORCING THE COMPLIANCE TO BATAS PAMBANSA BLG. 344 OF PRIVATELY-OWNED BUILDING SPACES LEASED BY GOVERNMENT OFFICES

WHEREAS, Batas Pambansa Blg. 344, also known as the Accessibility Law, mandates that all public and private buildings, including establishments that provide services to the public, ensure access to persons with disabilities by providing accessible facilities and features such as ramps, elevators, wider doors, and other necessary provisions for mobility and accessibility;

WHEREAS, it is the responsibility of government agencies renting privately-owned building spaces to ensure that the leased facility complies with the accessibility law;

WHEREAS, it should be the policy of the government to ensure compliance to Batas Pambansa Blg. 344 of leased privately-owned building spaces and that accessibility features are installed and available to persons with disabilities and those with mobility concerns;

WHEREAS, the Department of Public Works and Highways through its provincial districts and the Local Government Units through the PDAO as mandated by Batas Pambansa Blg. 344 and Republic Act no. 10070 respectively coordinate and provide technical assistance on compliance to accessibility law to government agencies leasing privately-owned building spaces

WHEREAS, 鶹ý Board Resolution No.4 S.2024, “A Resolution Delegating Approval of Succeeding Council Resolutions and/or its Equivalent to the 鶹ý Chairperson and Designated Officials”, duly authorized the 鶹ý Chairperson and the 鶹ý Executive Director to sign this Resolution for and on behalf of the 鶹ý Governing Board.

NOW THEREFORE, be it RESOLVED as it is hereby resolved, the 鶹ý Governing Board adopts this resolution enforcing the compliance to Batas Pambansa Blg. 344 of privately-owned building spaces leased by government offices.

HEREBY RESOLVED FURTHER, that the Department of Public Works and Highways

  1. Issue a corresponding memorandum regarding the implementation of this resolution including reporting government leased privately-owned building spaces compliance to accessibility law, technical assistance and necessary corrective actions
  2. Implement inspections of rented government agencies to ensure compliance with the Batas Pambansa 344.
  3. Coordinate with PDAOs, Organizations of Persons with disabilities or Federation of organization of persons with disabilities/ Office of Building Official (OBO) in the conduct of accessibility audit upon request.

A RESOLUTION CREATING THE 鶹ý SUB-COMMITTEE ON DISABILITY INCLUSIVE LOCAL GOVERNANCE

WHEREAS, Republic Act no. 10070, An Act Establishing an Institutional Mechanism

to Ensure the Implementation of Programs and Services for Persons with Disabilities in Every Province, City and Municipality, Amending Republic Act No. 7277 otherwise known as the “Magna Carta for Disabled Persons,” As Amended, and For Other Purpose provides that Persons with Disability Affairs Office (PDAO) shall be created in every province, city and municipality. Moreover, in consideration of budget restraints, local chief executives of fourth (4th), fifth (5th) and sixth (6th) class municipalities may, in lieu of the creation of a PDAO, designate a focal person who shall perform the functions of the PDAO;

WHEREAS, among the mandates of the Department of the Interior and Local Government (DILG) is to strengthen the capability of local government units to effectively deliver basic services to the citizenry including persons with disabilities;

WHEREAS, the DILG in its mission to uphold excellence in local governance and enable resilient and inclusive communities issued DILG Memorandum Circular No.

2021-041 on Strengthening the Functionality of Persons with Disability Affairs Offices (PDAO) and Persons with Disabilities Focal Person;

WHEREAS, there is a need to ensure that local government units adopt disability inclusion in all areas of governance and in the implementation of programs and services for persons with disabilities through relevant policies, guidelines and technical assistance;

WHEREAS, 鶹ý Board Resolution No. 4, S. 2024, “A Resolution Delegating Approval of Succeeding Council Resolutions and/or its Equivalent to the 鶹ý Chairperson and Designated Officials,” duly authorized the 鶹ý Chairperson and the 鶹ý Executive Director to sign this Resolution for and on behalf of the 鶹ý Governing Board;

NOW, THEREFORE, BE IT RESOLVED AS IT IS HEREBY RESOLVED, that the 鶹ý Governing Board approves the creation of the Sub-Committee on Disability Inclusive Local Governance which shall have the following composition and functions:

  1. Composition:

 

Chairperson: Department of the Interior and Local Government (DILG)

 

Members: Department of Social Welfare and Development (DSWD)

Local Government Academy (LGA)

Union of Local Authorities of the Philippines (ULAP)

League of Provinces of the Philippines (LPP)

League of Cities of the Philippines (LCP)

League of Municipalities of the Philippines (LMP)

Liga ng mga Barangay (LNB)

Three (3) LGU-PDAOs representing the League of Persons with Disabilities Affairs of the Philippines

 

  1. Functions:

 

  1. Formulate and recommend policies to the 鶹ý Governing Board to facilitate the full implementation of Republic Act no. 10070 otherwise known as the PDAO law and its Implementing rules and regulations;
  2. Develop guidelines for the effective and efficient operations of PDAOs;
  3. Establish and maintain a database on functionality of PDAOs as basis policy or program intervention;
  4. Promote disability inclusion in local governance through technical assistance and capacity building activities in collaboration with government and non-government organizations, and organizations of persons with disabilities;
  5. Advocate for the compliance and participation of local government units in various disability and accessibility compliance audits.

RESOLVED FURTHER, that the 鶹ý Secretariat shall provide technical and administrative support to the Sub-Committee in the conduct of quarterly meetings and activities.

RECOMMENDING TO THE OFFICE OF PRESIDENT OF THE PHILIPPINES TWO (2) NON-GOVERNMENTAL ORGANIZATION (NGO) REPRESENTATIVES AS MEMBERS OF THE 鶹ý GOVERNING BOARD

WHEREAS, Section 3 of Executive Order (EO) No. 709 titled “Redefining the Functions and Organizational Structure of the National Council for the Welfare of Disabled Persons” identified the composition of the 鶹ý, with twelve (12) government agencies and six (6) private individuals.

WHEREAS, the six (6) private individuals, all of whom shall be appointed by the President of the Philippines upon the favorable recommendation of the Chairperson shall be composed of the following:

  1. Two (2) representatives from the Non-Governmental Organizations (NGO’s)

with national network on Persons with Disabilities;

  1. Two (2) Persons with Disabilities representing legitimate Persons with

Disabilities organizations, and;

  1. Two (2) representatives from civic groups and cause-oriented organizations

concerned with the welfare of persons with disabilities

WHEREAS, the 鶹ý Governing Board (the “Board”) approved 鶹ý Board Resolution No. 01 Series of 2024 (the “Board Resolution”) “A Resolution Recommending the Criteria in the Selection of Non-Governmental Organizations (NGO) Representatives to the 鶹ý (鶹ý) Board”

WHEREAS, pursuant thereto, the 鶹ý Secretariat publicly sought the nominations for NGO Representatives to the Governing Board and presented all submitted nominations to the Board Members during the 2nd Quarter meeting on 26 June 2024.

WHEREAS, during the 2024 2nd Quarter meeting the Board instructed the 鶹ý Secretariat to come up with a shortlist of twelve (12) nominees who met all the criteria/qualification as set in the Board Resolution and had submitted all documentary requirements. The Board, in its pursuit to properly assess the skills and knowledge of the Nominees related to the roles, functions and responsibilities of NGO Representative Board Members created the 鶹ý Board Core Group composed of five (5) Member Agencies: Department of Social Welfare and Development, Department of Education, Department of Justice, Department of Health and Department of the Interior and Local Government to conduct the Panel interview of the shortlisted nominees.

WHEREAS, The 鶹ý Secretariat assessed the requirements of all the nominations and made sure that the shortlisted twelve (12) submitted complete requirements, met the minimum qualification as stated in BR. No. 1 Series of 2024

WHEREAS, during the 2024 3rd Quarter Board Meeting, the 鶹ý Secretariat presented the twelve (12) shortlisted nominees with their corresponding Interview ranking scores to the Board. The Board unanimously agreed to endorse the Six (6) Nominees, who garnered the top scores in each category, for consideration and approval of the President by approving Board Resolution No. 6 Series of 2024 ‘Recommending to the President Six (6) NGO Representatives to the 鶹ý Governing Board’ which was signed into final approval on 12 November 2024.

WHEREAS, the Chairperson of the 鶹ý formally submitted the endorsement letter of the Recommended Six NGO Representatives to the Office of the President on 22 November 2024.

WHEREAS, the Office of the President issued the Letter of Appointment of Four (4) out of the Six (6) endorsed Nominees on 07 April 2025;

WHEREAS, the appointment of four (4) out of the six (6) endorsed nominees left two (2) vacant seats for the NGO Representation to the 鶹ý Governing Board, the 鶹ý Secretariat Office proposed to submit two (2) additional Nominees for consideration of endorsement by the 鶹ý Governing Board with the guidance provided by the Presidential Management Staff Office and the Department of the Social Welfare and Development.

WHEREAS, the nominees’ qualifications and documentary requirements passed the initial assessment of the 鶹ý Secretariat and earned them a placement in the shortlisted applicants, and was among the nominees who underwent the panel interview with 鶹ý Core Group.

WHEREAS, after the presentation of the nominees to the 鶹ý Governing Board during the 2025 2nd Quarter Meeting and upon completion with the validation check and a review of their qualifications by the 鶹ý Secretariat, the 鶹ý Governing Board agreed to endorse the nominees for consideration and approval of the President

WHEREAS,鶹ý Board Resolution No.4 S.2024, “A Resolution Delegating Approval of Succeeding Council Resolutions and/or its Equivalent to the 鶹ý Chairperson and Designated Officials”, duly authorized the 鶹ý Chairperson and the 鶹ý Executive Director to sign this Resolution for and on behalf of the 鶹ý Governing Board.

NOW, THEREFORE, BE IT RESOLVED AS IT IS HEREBY RESOLVED, that the 鶹ý Governing Board adopts this resolution to endorse the two (2) nominees as NGO Representatives to the 鶹ý Governing Board for the President of the Philippine’s consideration and approval

RESOLVED FURTHER, that the 鶹ý Secretariat shall prepare the endorsement letter for the President of the Philippines which will include supporting documents on Nominees qualifications, to be signed by the 鶹ý Chairperson.

RESOLUTION AMENDING BOARD RESOLUTION NO. 5 SERIES 2025 A RESOLUTION CREATING THE INTER-AGENCY TECHNICAL WORKING GROUP ON THE DEVELOPMENT OF THE UNIFIED ID SYSTEM FOR PERSONS WITH DISABILITIES TO INCLUDE THE NATIONAL PRIVACY COMMISSION IN ITS MEMBERSHIP

WHEREAS, Republic Act No. 9442 or the Magna Carta for Persons with Disabilities, as amended and Republic Act No. 10754, otherwise known as An Act Expanding the Benefits and Privileges of Persons with Disabilities, mandate the provision of 20% discounts and VAT exemption on certain goods and services to persons with disabilities;

WHEREAS, RA No. 9442 further provides that the abovementioned privileges are available only to Persons with Disabilities who are Filipino citizens upon submission of proof of his/her entitlement thereto – an identification card issued by a municipal mayor, or barangay captain of the place where the person with disabilities reside;

WHEREAS, pursuant to said RA No. 9442, the 鶹ý (鶹ý) issued Administrative Order No. 001, series of 2021 which provides for the guidelines in the issuance of PWD-IDCs Under the AO, PWD-IDCs are issued by the Local Government Units (LGUs) through the Persons with Disability Affairs Offices (PDAOs) or the Local Social Welfare Development Offices (LSWDOs);

WHEREAS, 鶹ý Board Resolution No. 5 Series of 2025 titled “A Resolution Creating the Inter-Agency Technical Working Group on the Development of the Unified ID System for Persons with Disabilities” was approved and signed on 21 April 2025 as a measure to control the proliferation of fake PWD-IDCs through the creation of an Inter-Agency Technical Working Group (IATWG) that will develop the Unified ID System for Persons with Disabilities Identification Cards.

WHEREAS, the National Privacy Commission (NPC), was identified and invited to be a member of the IATWG, pending their acceptance of the membership. The NPC shall counsel the IATWG on data privacy matters. The NPC submitted their acceptance of the Invitation 28 April 2025.

WHEREAS,鶹ý Board Resolution No.4 S.2024, “A Resolution Delegating Approval of Succeeding Council Resolutions and/or its Equivalent to the 鶹ý Chairperson and Designated Officials”, duly authorized the 鶹ý Chairperson and the 鶹ý Executive Director to sign this Resolution for and on behalf of the 鶹ý Governing Board.

NOW, THEREFORE, BE IT RESOLVED AS IT IS HEREBY RESOLVED, that the 鶹ý Governing Board approves the inclusion of the National Privacy Commission as a member of the Inter-Agency Technical Working Group on the Development of the Unified ID System for Persons with Disabilities.

RESOLUTION TO ESTABLISH GUIDELINES FOR THE 鶹ý BIENNIAL RECOGNITION PROGRAM WHICH TAKE PLACE EVERY TWO YEARS DURING 鶹ý FOUNDATION ANNIVERSARY

WHEREAS, Executive Order No. 709, s.2008 redefined the functions and organizational structure of the 鶹ý aimed to strengthen its role in promoting and protecting the rights and well-being of persons with disabilities.

WHEREAS, during the 4th Quarter Meeting of the Governing Board on November 9, 2022, the Board members agreed to institutionalize the Annual Recognition event in 2023.They discussed ways to enhance the selection criteria and categories for this event.

WHEREAS, in 2023, the 鶹ý started an Annual Recognition Program to honor employers who hire people with disabilities and to recognize employees with disabilities. This program was launched to celebrate the International Day of Persons with Disabilities.

WHEREAS, over the past four years, different awards have been given to recognize outstanding individuals with disabilities.These awards highlight their achievements in various fields.

WHEREAS, the 鶹ý will rename the award to the Biennial Recognition Program, which will be held every two years.This change is meant to enhance the planning and evaluation of candidates.The program aims to honor exceptional contributions in the field and ensure that deserving individuals and organizations are recognized.It focuses on fairness and transparency in the selection process.

WHEREAS, 鶹ý Board Resolution No.4 S.2024, “A Resolution Delegating Approval of Succeeding Council Resolutions and/or its Equivalent to the 鶹ý Chairperson and Designated Officials”, duly authorized the 鶹ý Chairperson and the 鶹ý Executive Director to sign this Resolution for and on behalf of the 鶹ý Governing Board.

NOW, THEREFORE, RESOLVED as it is hereby resolved, the Annual Recognition Program will be renamed the Biennial Recognition Program and will be held every two years, beginning in 2026.

RESOLVE FURTHER, the awarding event starting 2026 shall be on the 11th day of June to coincide with the 鶹ý’s Foundation Anniversary.

WHEREFORE, A Technical Working Group will be established this year, led by the 鶹ý Deputy Executive Director and supported by the Information, Education Communication Division.The group will create guidelines, criteria, and categories for awards and provide regular updates to the 鶹ý Governing Board.

A RESOLUTION CREATING THE INTER-AGENCY TECHNICAL WORKING GROUP ON THE DEVELOPMENT OF THE UNIFIED ID SYSTEM FOR PERSONS WITH DISABILITIES

 

WHEREAS, Republic Act Nos. 9442 and 10754 provide persons with disabilities with 20% discounts and VAT exemption on certain goods and services which can be availed upon presentation of persons with disabilities identification cards (PWD-IDC);

WHEREAS, the abovementioned privileges are available only to persons with disability who are Filipino citizens upon submission of proof of his/her entitlement thereto an identification card issued by the city or municipal mayor, the barangay captain of the place where the person with disability resides;

WHEREAS, PWD-IDC are issued by the Local Government Units (LGUs) through the Persons with Disability Affairs Office (PDAOs) or the Local Social Welfare and Development Offices as per 鶹ý Administrative Order No. 1 series of 2021;

WHEREAS, 鶹ý received reports on the fraudulent use of fake PWD-IDCs, which were purchased through online platforms or legitimately issued to non-eligible persons, in order to avail of discounts and privileges exclusive for persons with disabilities;

WHEREAS, some LGUs have initiated their own system on PWD-IDC issuance including assigning individual number, card design and different security measures to ensure its authenticity and safeguard the rights of persons with disabilities;

WHEREAS, there is a need to unify the different systems of PWD-IDC issuance currently practiced by various LGUs. This is to come up with a standard assessment of eligibility for PWD-IDC issuance. Moreover, a standard design of the disability card with security features that can be printed and issued only by authorized offices.

WHEREAS,鶹ý Board Resolution No. 4 S. 2024, “A Resolution Delegating Approval of Succeeding Council Resolutions and/or its Equivalent to the 鶹ý Chairperson and Designated Officials, duly authorize the 鶹ý Chairperson and the 鶹ý Executive Director to sign this Resolution for and on behalf of the 鶹ý Governing Board;

NOW, THEREFORE, RESOLVED, as it is HEREBY RESOLVED, the 鶹ý Governing Board adopts this resolution to organize an Inter-Agency Technical Working Group on the Development of the Unified ID System for Persons with Disabilities (ITWG-UISPWD);

RESOLVED FURTHER, that the said technical working group shall have the following composition and functions:

  2. Department of Health
  3. Department of the Interior and Local Government
  4. Department of Information, Communication and Technology
  5. Department of Trade and Industry
  6. National Privacy Commission
  7. Philippine Statistics Authority
  8. Representative from the League of Persons with Disabilities Affairs Office

 

  1. Functions:

 

  1. Review existing systems of PWD-IDC issuances and disability card designs
  2. Recommend the standard design of the PWD-IDC including security features to ensure integrity and authenticity, and for verification purposes
  3. Formulate guidelines for the unified ID system for persons with disabilities in consultation with concerned organizations
  4. Recommend institutional coordination mechanisms in addressing queries, complaints and grievances relative to PWD-IDC issuance and use.

RESOLUTION REITERATING THE AVAILMENT OF 20% DISCOUNT

AND 12% VAT EXEMPTION ON PURCHASE OF GOODS, AND 5% DISCOUNT ON PURCHASE OF BASIC NEEDS AND COMMODITIES TO PERSONS WITH DISABILITIESTHROUGH AUTHORIZED REPRESENTATIVES

WHEREAS, Republic Act No. 9442, otherwise known as the “Magna Carta for Persons with Disabilities, as Amended,” and Republic Act No. 10754, also known as An Act Expanding the Benefits and Privileges of Persons with Disabilities,” provide persons with disabilities with 20% discount and VAT exemption on purchase of certain goods and services for their exclusive use and enjoyment.”

WHEREAS, pursuant to RA10754, or An Act Expanding the Benefits and Privileges of Persons with Disability, amending RA Nos.7277, 9442 and 10070, the government may grant special discounts in special programs for Persons with Disabilities on their purchase of basic commodities which is separate and distinct from the twenty percent (20%) discount provided under RA10754;

WHEREAS, Section 6 of DTI-DOE-DA Joint Administrative Order no. 24-02 series of 2024, or the “Revised Rules on Granting Special Discounts to Senior Citizens and Persons with Disability on Purchase of Basic Necessities and Prime Commodities,” reiterates the rights of persons with disabilities to purchase their basic goods through a representative by issuing a signed authorization letter which shall be valid seven (7) days from the date of the issuance;

WHEREAS, pursuant to the said DTI-DOE-DA JAO No.24-02, series of 2024, the purchase of goods and availment of applicable discount privileges through an authorized representative of persons with disabilities is considered an acceptable practice and a form of reasonable accommodation particularly for those with mobility limitations;

WHEREAS, in response to the clamor of the disability sector for clarification, the Sub-Committee on Policy Development and Legislation drafted a Public Advisory regarding the provision of disability discounts on purchase of goods for take-out and delivery through authorized representatives of persons with disabilities;

WHEREAS,鶹ý Board Resolution No. 4 S. 2024, “A Resolution Delegating Approval of Succeeding Council Resolutions and/or its Equivalent to the 鶹ý Chairperson and Designated Officials”, duly authorized the 鶹ý Chairperson and the 鶹ý Executive Director to sign this Resolution for and on behalf of the 鶹ý Governing Board.

NOW THEREFORE, BE IT RESOLVED, as it is hereby resolved, the Board adopts this resolution reiterating the right of persons with disabilities to avail the 20% discount and 12% VAT exemption to persons with disabilities on purchase of goods through authorized representatives.

RESOLVE FURTHER, that the Board approves the Public Advisory on the availment of the 20% discount and 12% VAT exemption of persons with disabilities through their representatives prepared by the Sub-Committee on Policy Development and Legislation, and requests the Philippine Information Agency (PIA) for the nationwide dissemination of the said information.
